It costs nothing to find out
If you are reading this and thinking you cannot afford a lawyer, read this part first. Personal injury lawyers do not charge you to talk, do not charge by the hour, and do not charge anything unless they recover money for you. The fee comes out of the recovery at the end, never out of your pocket. The first conversation is free. Call Clyne is free too: we ask you a few questions and connect you with a licensed Florida attorney who looks at your case at no cost. Nobody will ask you for money. First, the two things that matter most in Florida
See a doctor within 14 days. Florida is a no-fault state, and your own policy's Personal Injury Protection pays your first medical bills no matter who caused the crash, but only if you get treatment within 14 days. Port Orange has two emergency rooms inside the city, both freestanding. AdventHealth Port Orange ER at 5811 Williamson Boulevard, near Interstate 95 and the Pavilion at Port Orange, is a 24-bed adult and pediatric emergency department run as part of AdventHealth Daytona Beach, and Halifax Health Medical Center of Port Orange at 1041 Dunlawton Avenue has its own emergency department tied to the main Halifax campus. Neither is a state-designated trauma center. The most seriously injured crash victims are usually taken to Halifax Health Medical Center at 303 North Clyde Morris Boulevard in Daytona Beach, the Level II trauma center for the area and the only one in Volusia County, about eight miles north by Clyde Morris Boulevard or Nova Road. Urgent care or your own doctor counts too. Read the 14-day rule guide.
Do not give the other driver's insurer a recorded statement. They will call fast and sound friendly. You are not required to talk to them. Read what to say when they call.
Getting your crash report in Port Orange
Inside city limits, the Port Orange Police Department responds to crashes, and its traffic unit investigates the serious ones. Its headquarters is at 4545 South Clyde Morris Boulevard, near City Hall and the Dunlawton Avenue government complex, and the records division there handles crash report requests Monday through Friday from 8 a.m. to 5 p.m., by phone at 386-506-5801, and through an online public records portal on the city website. The city lines are tangled here: South Daytona, Daytona Beach, Daytona Beach Shores, Ponce Inlet and New Smyrna Beach each have their own police department, and the unincorporated pockets around Spruce Creek, Samsula and the land west of Interstate 95 are covered by the Volusia County Sheriff's Office, so a crash on the far side of Nova Road, Taylor Road or the Dunlawton bridge may belong to a different agency. On Interstate 95, and often on US 1 and State Road 421 outside the city, it is the Florida Highway Patrol. Ask the officer at the scene which agency wrote the report and get the report number.
Florida crash reports are available online through the state's Florida Crash Portal, usually within about ten days, and from the responding agency's records unit. For the first 60 days the report is only available to the people involved, their insurers and their lawyers, so have your license and the report number ready.
Roads where Port Orange crashes happen
The stretches that come up most: Dunlawton Avenue, which is State Road 421 from Interstate 95 east past Williamson Boulevard, Clyde Morris Boulevard, Nova Road and Ridgewood Avenue to the bridge over the Halifax River, the city's main east-west road and its busiest shopping corridor, a wide, fast road lined with plazas, car lots and driveways, where police have responded to fatal crashes in the 1700 block and where a motorcyclist was killed, Nova Road, which is State Road 5A from South Daytona south through the city to Spruce Creek Road, US 1, which is Ridgewood Avenue along the river, Clyde Morris Boulevard from Daytona Beach south past Dunlawton to Taylor Road, Williamson Boulevard from the Pavilion south past the hospital toward Airport Road, where a driver was killed in June 2026 and police asked for witnesses, Taylor Road from Interstate 95 east toward Spruce Creek, where a man died in a single-vehicle crash near the interstate, Spruce Creek Road, Herbert Street, and Interstate 95 along the west side of the city with exits at Dunlawton Avenue and Taylor Road, where fatal crashes have shut the highway. On Dunlawton, Nova and Ridgewood the crashes are rear-ends at the lights, left turns across three lanes into a plaza, and lane changes around a car slowing to turn, and pedestrians have been struck crossing at night. On Interstate 95 they are high speed with several vehicles, and race week and Bike Week traffic add their own problems. Photos of the intersection, the signals and the lane markings matter, because these crashes often turn into arguments about who had the light or who changed lanes.

Know the Florida clock
For most car accident injury claims in Florida you have two years from the date of the crash to file a lawsuit, and if you are found more than half at fault you recover nothing. Both changed in 2023. Details in How Long Do You Have to File in Florida.
When to talk to a lawyer
Not every fender bender needs one. Talk to a lawyer when you were injured and are still treating after a week or two, when the other driver was uninsured or fled, when fault is being disputed, or when you missed work. Florida personal injury lawyers work on contingency, which means no fee unless they recover money for you, and the first conversation is free.
