Call Clyne is a lawyer referral service, not a law firm. Nothing here is legal advice. It is free, and so is talking to us.

It costs nothing to find out

If you are reading this and thinking you cannot afford a lawyer, read this part first. Personal injury lawyers do not charge you to talk, do not charge by the hour, and do not charge anything unless they recover money for you. The fee comes out of the recovery at the end, never out of your pocket. The first conversation is free. Call Clyne is free too: we ask you a few questions and connect you with a licensed Florida attorney who looks at your case at no cost. Nobody will ask you for money. First, the two things that matter most in Florida

See a doctor within 14 days. Florida is a no-fault state, and your own policy's Personal Injury Protection pays your first medical bills no matter who caused the crash, but only if you get treatment within 14 days. Winter Garden has a hospital at its south end. Orlando Health Horizon West Hospital, in the Horizon West community off State Road 429 near Hamlin, opened in 2021 next to a 24-hour emergency department that has been there since 2018. Orlando Health Health Central Hospital, at 10000 West Colonial Drive in Ocoee, is a few minutes east on State Road 50 and also has a 24-hour emergency room. Neither is a state-designated trauma center, so the most seriously injured crash victims are usually taken to Orlando Regional Medical Center in downtown Orlando, the Level I trauma center for the region, about 15 miles east on State Road 408. Urgent care or your own doctor counts too. Read the 14-day rule guide.

Do not give the other driver's insurer a recorded statement. They will call fast and sound friendly. You are not required to talk to them. Read what to say when they call.

Getting your crash report in Winter Garden

Inside city limits, the Winter Garden Police Department responds to crashes, and its traffic homicide unit investigates the serious ones. Its headquarters is at 251 West Plant Street downtown, and the records management division there handles crash report requests on weekdays during business hours. The city lines are tangled here: Ocoee, Oakland and Windermere each have their own police department, and Horizon West, Hamlin, Gotha and the pockets of unincorporated Orange County between the subdivisions are covered by the Orange County Sheriff's Office, so a crash on the far side of Avalon Road, Winter Garden Vineland Road or Colonial Drive may belong to a different agency. Across the Lake County line toward Clermont it is the Lake County Sheriff's Office or the Clermont Police. On State Road 429 and Florida's Turnpike it is usually the Florida Highway Patrol. Ask the officer at the scene which agency wrote the report and get the report number.

Florida crash reports are available online through the state's Florida Crash Portal, usually within about ten days, and from the responding agency's records unit. For the first 60 days the report is only available to the people involved, their insurers and their lawyers, so have your license and the report number ready.

Roads where Winter Garden crashes happen

The stretches that come up most: West Colonial Drive, which is State Road 50, from the Ocoee line west past Daniels Road, Dillard Street, the State Road 429 interchange and Avalon Road toward Oakland and the Lake County line, a wide, fast road lined with plazas, car lots and driveways, State Road 429, the Western Beltway, which cuts through the city with exits at Plant Street, Winter Garden Vineland Road and New Independence Parkway, where high-speed, head-on and rollover crashes have killed drivers, including a fatal crash near mile marker 17 south of Winter Garden Vineland Road in December 2025, Winter Garden Vineland Road, which is State Road 535, from Colonial Drive south past Stoneybrook West Parkway and the 429 ramps toward Windermere, Dillard Street from Colonial Drive south through Story Road to downtown, where a pedestrian was killed in the crosswalk at East Story Road in 2026, Avalon Road, which is County Road 545, south through Horizon West and Hamlin, Plant Street, which is State Road 438, through downtown and east to Ocoee, Daniels Road, Tilden Road, Fullers Cross Road and Hamlin Groves Trail, and Florida's Turnpike where it meets State Road 429 on the Ocoee line. On Colonial, Winter Garden Vineland and Dillard the crashes are rear-ends at the lights, left turns across traffic into a plaza, and lane changes around a car slowing to turn, and pedestrians and cyclists have been struck near downtown and the West Orange Trail crossings. On 429 and the Turnpike they are high speed with several vehicles. Photos of the intersection, the signals and the lane markings matter, because these crashes often turn into arguments about who had the light or who changed lanes.

What to do in the first 48 hours

  • Call 911 and get a report, even for a "small" crash.
  • Photograph both cars, both licenses, both insurance cards, and the scene.
  • See a doctor within 14 days. Sooner is better.
  • Report the crash to your own insurer. Facts only.
  • Do not accept a quick check or sign anything from the other driver's insurer.
  • Keep every bill, receipt and visit summary.

Know the Florida clock

For most car accident injury claims in Florida you have two years from the date of the crash to file a lawsuit, and if you are found more than half at fault you recover nothing. Both changed in 2023. Details in How Long Do You Have to File in Florida.

When to talk to a lawyer

Not every fender bender needs one. Talk to a lawyer when you were injured and are still treating after a week or two, when the other driver was uninsured or fled, when fault is being disputed, or when you missed work. Florida personal injury lawyers work on contingency, which means no fee unless they recover money for you, and the first conversation is free.
